Sabinsa Corporation Takes Legal Action Against Two Companies For Alleged ForsLean® Patent Infringement
   
 

PISCATAWAY, NJ – Sabinsa Corporation has served legal notices to two raw material brokers for alleged patent infringement on ForsLean® , the company's patented lean body mass dietary supplement ingredient.

"Prior to Sabinsa's launching its ForsLean marketing campaign, sales of Coleus forskohlii extracts in the US were negligible," notes Todd Norton, President of Sabinsa Corporation. "We have mechanisms in place to track nutritional ingredients exported from India into the US. We also have ways to ascertain whether ForsLean® is being used in finished products to consumers."

In recent months, several manufacturers from India have begun supplying Coleus extracts in increasing quantities to US brokers at potency levels close to, or identical to, what Sabinsa has clinically evaluated, indicating a borrowing of Sabinsa's discovery. Norton adds, "This increase in demand is not an accident. Given the potency levels in which these extracts are being supplied, their intended use is clear. This flies straight into the teeth of our patent."

Because Sabinsa discovered the weight loss properties of forskohlin in humans, which is not a traditional use of the Coleus active, the company was granted Patent #5,804,596, for its use and composition in promotion of lean body mass, reduction of adipose tissue (fat) and weight loss.

Norton concludes, "There is absolutely no evidence in the dietary supplement industry that would support an increase in Coleus requirements for traditional, established applications. This activity is the direct result of Sabinsa’s efforts in promoting and educating the dietary supplement industry on the patented application claims and proprietary benefits of ForsLean, and nothing else. We have invested an enormous amount of resources in product development as well as initial and ongoing clinical, safety and toxicity studies. We have not granted anyone a free license to use our intellectual property, nor do we intend to. We will continue to watch for generic knockoffs and will employ whatever legal action necessary to protect our property."
